Introduction
Welcome to Cleanesty ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website (https://cleanesty.com), mobile applications, and cleaning services ("Services") provided by Cleanesty in Bangkok, Thailand. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Eligibility
To use our Services, you must:
- Be at least 18 years old or have the consent of a parent or guardian.
- Reside in an area where we offer our Services (primarily Bangkok, Thailand).
- Not be prohibited from using our Services under applicable law.
2. Services Provided
Cleanesty provides professional cleaning services, including but not limited to:
- Home cleaning
- Sofa cleaning, mattress cleaning, carpet cleaning, and other deep cleaning services
- Laundry, ironing, and shoe shining
- Washing dishes, grocery shopping, cooking assistance, trash removal, watering plants, and checking mailboxes
We reserve the right to modify, suspend, or discontinue any Service at any time without notice, though we will endeavor to notify you of significant changes.
3. Booking and Payment
- Booking: You can book our Services through our website or mobile app. You must provide accurate information, including your address, contact details, and special instructions (e.g., access codes, pet details).
- Payment: Payment is due at the time of booking. We accept payments via credit/debit cards, PayPal, and cash (if selected). All prices are in Thai Baht (THB) and include applicable taxes.
- Pricing: Base rates start at 750 THB per 2 hours per cleaner with your equipment, or 825 THB with Cleanesty equipment. Additional services (e.g., sofa cleaning, pet hair cleaning) incur extra fees as outlined on our Services page.
- Cancellations and Refunds:
- For one-time bookings, you may cancel up to 3 hours before the appointment for a refund, subject to a 5% cancellation fee to cover payment gateway and administrative costs. No refunds are available for cancellations within 3 hours of the appointment.
- For multi-package bookings, cancellations must be made at least 3 hours before the first appointment, with a 5% cancellation fee. No refunds are available after this time.
- Multi-package credits are valid for 90 days after the first appointment and are non-transferable.
4. User Responsibilities
- Accurate Information: You agree to provide accurate and complete information when booking our Services, including access instructions and pet details.
- Property Access: You must ensure our cleaners have safe and unobstructed access to your property. You are responsible for providing accurate access instructions (e.g., gate codes, intercom details).
- Safety and Conduct: You must ensure a safe working environment for our cleaners. We reserve the right to suspend or terminate services if the environment is deemed unsafe (e.g., presence of hazardous materials, excessively unhygienic conditions).
- Prohibited Activities: You agree not to:
- Use our Services for any illegal or unauthorized purpose.
- Attempt to access, modify, or interfere with our systems, networks, or data.
- Engage in abusive, harassing, or threatening behavior toward our cleaners or staff.
- Use our Services to infringe on any third-party rights (e.g., intellectual property, privacy).
5. Cleaner Responsibilities
Cleaners working with Cleanesty agree to:
- Provide services with a high degree of professionalism and in accordance with industry standards.
- Comply with all applicable laws and regulations.
- Maintain the confidentiality of customer information and use it solely for providing the requested services.
Cleaners contract directly with customers for the provision of services. In the event of a dispute between a cleaner and a customer, the cleaner’s recourse is against the customer, not Cleanesty.
6. Intellectual Property
All content on our website, including text, images, logos, and designs, is the property of Cleanesty or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.
7. Limitation of Liability
- Service Limitations: Cleanesty does not provide "big cleaning" services (e.g., post-move-out cleaning, cleaning after prolonged neglect, or room reforms). We are not responsible for damages resulting from pre-existing conditions (e.g., mold, structural issues).
- Property Damage: While our cleaners are trained and insured, we are not liable for damage to property caused by normal wear and tear, pre-existing conditions, or your failure to secure fragile items. Any claims for damage must be reported within 24 hours of the service, and we will investigate promptly.
- General Liability: To the fullest extent permitted by law, Cleanesty, its officers, employees, agents, and affiliates will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our Services, including but not limited to loss of data, profits, or property damage. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.
- Third-Party Actions: We are not responsible for the actions, omissions, or conduct of third parties, including cleaners, payment processors, or other users of our Services.
8. Indemnification
You agree to indemnify, defend, and hold harmless Cleanesty, its officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from:
- Your use of our Services in violation of these Terms.
- Your violation of any applicable law or third-party rights (e.g., intellectual property, privacy).
- Any content or information you provide through our Services.
- Any dispute between you and a cleaner or other third party.
9. Termination
We may suspend or terminate your access to our Services at our sole discretion, with or without notice, if:
- You breach these Terms.
- We suspect fraudulent, abusive, or illegal activity.
- It is necessary to protect the safety, security, or rights of Cleanesty, our users, or the public.
Upon termination, your right to use our Services will cease immediately. We may also delete your account and associated data, subject to our data retention policies.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of Thailand. Any disputes arising from these Terms or your use of our Services shall be resolved through negotiation in good faith. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts in Bangkok, Thailand.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services or legal requirements. We will notify you of significant changes by posting the updated Terms on our website with a new "Last Updated" date. Your continued use of our Services after such changes constitutes your acceptance of the updated Terms.
